Purchase Definition.

The website (eshop.stargassrl.com, hereinafter the "Site") of Stargas Srl, with legal address in Strada Provinciale Pianura Loc. S. Martino, 37 Pozzuoli (NA) – Italy, Tel. +39 0815267978 - Fax +39 0815264771 - E-mail: info@stargassrl.it , VAT number: IT-03209410632, contains the catalogue of products marketed by Stargas srl.

By registering with the Site, you approve and accept these General Conditions of Sale (hereinafter the "General Conditions") and all provisions concerning the use of the Site, including, but not limited to, the terms and General Conditions of Use of the Site and the Site Privacy Statement, published on other pages of the Site, which regulate the registration, access, navigation and in general the use of the Site.

The Site and the material contained herein is not an offer to the public, but are only a mere invitation to offer. Each order of products transmitted to Stargas Srl by a customer (hereinafter "the Customer") constitutes  a Customer's contract proposal and, therefore, will be binding for Stargas Srl only if, and when, confirmed for acceptance by Stargas Srl. Stargas Srl will send the acceptance by e-mail after checking the completeness and correctness of the order as well as the availability of the ordered products. This e-mail of acceptance (hereinafter "Order Confirmation) is, therefore, sent by Stargas Srl to the Customer before shipment of the products.

The contract is deemed concluded at the time when the Order Confirmation has reached the mail server used by the Customer. The General Conditions are governed by the Italian Legislative Decree dated September 6th, 2005, n. 206 (hereinafter, the "Consumer Code"), as amended by the Italian Legislative Decree dated February 21st, 2014, n. 21, implementing the Directive 2011/83/EC and by the Italian Legislative Decree dated April 9th, 2003, n. 70, implementation of the Directive 2000/31/EC on certain legal aspects of the electronic commerce.

The contract will be filed through an electronic system and will be accessible to: the staff of Stargas Srl that will need to know relevant details, in order to process it; to any third parties entitled by Stargas Srl for correct execution of the contract; to the legitimate recipients, according to the norms in force. By sending to Stargas Srl the order form, the Customer agrees to the use by Stargas Srl of his phone number, e-mail address and other call systems, in relation to the conclusion and execution of the contract.

 

Orders.

In order to buy through the site, you need to log in. If you do not have an active profile, then you must register.

When you login, you log on to your profile ("My Account"), where you can view the history of your orders, monitor the status of orders in progress, use the "shopping lists", change the access password and change the data entered at registration.

To place orders, users must wait that the operators of Stargas Srl check the entered data. The successful activation of the profile will be notified to the user through an e-mail.

The ordering procedure is a process that includes several stages:

1. Login.

2. Select the products you wish to buy and add them to your cart.

3. Confirmation of the delivery address.

4. Select the method of shipment.

5. Choose the type of payment.

6. Final check with acceptance of the contract terms.

The system will immediately send a confirmation of receipt of the order.

 

The acceptance of the order by Stargas Srl will happen with the issuance of an "order confirmation" that will be sent to the Customer by e-mail.

In case the chosen method of payment for the order is a bank transfer, the ordered products will be shipped after notification of the payment received by Stargas Srl from the bank, usually 24-48 hours after its execution.

 

Consumers and Privacy.

all the mandatory provisions of law for protection of consumers are without prejudice, meaning as consumers those acting outside of their professional activities, under the definition of “consumer” contained in art. 3 of the Consumer Code. With reference to the processing of personal data of the customer, refer to the "Privacy Policy".

 

Disputes.

These General Conditions are governed by Italian law. Without prejudice to the applicability of mandatory provisions of law for the protection of consumers (as defined under article 3 of the Consumer Code) in reference to the jurisdiction (art. 33 paragraph 2, letter. (U) of the Consumer Code), any dispute not related to consumers, but related to these General Terms and Conditions, shall be under the exclusive jurisdiction of the Court of Pozzuoli, Italy.
